GENERAL TERMS AND CONDITIONS OF E-COMMERCE SALES

In light of Legislative Decree no. 21 of February 21, 2014, implementing Directive 2011/83/EU, the offer and sale of products on the website www.cavenezialux.com are governed by these General Terms and Conditions of Sale, in compliance with the provisions of Legislative Decree no. 206/2005 (Consumer Code) and subsequent amendments. Before placing an order, the Customer is required to read these General Terms and Conditions of Sale carefully. Placing an order implies full knowledge and acceptance of both the General Terms and Conditions of Sale and the content specified in the Order Form.

Upon completing the online purchase procedure, the Customer must print and retain the General Terms and Conditions of Sale and the Order Form.

1. OBJECT

The General Terms and Conditions of Sale govern the online sale of products through the e-commerce service on the website www.fralab.it.

2. PARTIES

The products are sold directly by Nicola Ceretta Exclusive Sales – FraLab, Tax Code CRTNCL83M19F464A, VAT no. 04036910240, headquartered at Via Mascagni 9, 36070 Trissino (VI), Italy, and registered with the Vicenza Business Register under no. VI-373846, as the owner of the website http://www.fralab.it.

Products are sold to the Customer identified by the data provided during the completion and submission of the electronic Order Form.

3. PRODUCT AVAILABILITY

The availability of products is based on their status at the time the Customer views the website and product page. However, this is purely indicative, as other users on the site may purchase the products before the order is confirmed.

Even after sending the order confirmation email, partial or total unavailability of products may occur. In such cases, Nicola Ceretta Exclusive Sales – FraLab will promptly inform the Customer, who can choose to either accept delivery of only the available products or request the cancellation of the entire order by email.

4. PRICES

All product prices displayed on the website www.fralab.it are in Euros and include VAT.

Shipping costs are not included in the purchase price and will be calculated and displayed during the checkout process before payment is made.

5. PRODUCT ORDERS

The essential characteristics and prices of products are listed in the offers for each product.

Nicola Ceretta Exclusive Sales – FraLab strives to accurately describe and present the items sold on the website www.fralab.it. However, errors, inaccuracies, or minor differences between the website and the actual product may occur. Product images on the website are illustrative and not contractual.

To purchase products, the Customer must complete and send the electronic Order Form to Nicola Ceretta Exclusive Sales – FraLab by following the instructions on the website. The Customer must add the product to their cart, review the General Terms and Conditions (especially regarding delivery fees, the right of withdrawal, and privacy), select the desired payment method, and click "submit order."

By submitting the order, the Customer acknowledges and declares having reviewed all instructions provided during the purchase process and fully accepts the General Terms and Conditions of Sale.

Nicola Ceretta Exclusive Sales – FraLab reserves the right to evaluate and accept orders. Any inability to accept an order will be communicated to the Customer within 48 business hours after the order is submitted, and any payments made will be refunded.

6. CONTRACT CONCLUSION AND EFFECTIVENESS

The sale is deemed concluded when Nicola Ceretta Exclusive Sales – FraLab sends an email confirmation of the order to the Customer. This email includes customer details, order specifics, product prices, shipping costs, and the shipping address.

FraLab is committed to delivering the goods within 30 days from the day following the order confirmation.

7. PAYMENT METHODS

For maximum security, Nicola Ceretta Exclusive Sales – FraLab relies on PayPal to handle all transactions. PayPal is a leading escrow service for e-commerce payments, ensuring secure payment processing.

During payment, customers are temporarily redirected to PayPal's website to enter the necessary transaction details securely. Payments can be made in two ways:
a) Credit card (Visa or Mastercard) without registering for PayPal services
b) PayPal account

Once payment is completed, customers are redirected back to the website to view the order summary.

8. DELIVERY METHODS

For every order placed on the website www.fralab.it, Nicola Ceretta Exclusive Sales – FraLab issues an invoice, sent via email to the order holder. The details provided by the Customer during the order process are used for invoicing. No changes to the invoice are possible after issuance.

Delivery fees are the Customer's responsibility unless explicitly stated otherwise during checkout.

Customers must verify upon delivery:

  • The number of packages matches the delivery document.
  • Packaging is intact, undamaged, and unaltered.

Any damages or discrepancies must be reported immediately by noting "subject to inspection" and specifying the issue on the courier's delivery document.

Uncollected items returned to FraLab due to failed delivery attempts will incur storage costs charged to the Customer.

9. RIGHT OF WITHDRAWAL

In compliance with the Consumer Code, the Customer (a consumer purchasing for non-business purposes) has the right to withdraw from the purchase contract without penalty within 14 business days from receipt of goods.

Details on withdrawal procedures, return conditions, and refunds are outlined in this section.

10. WARRANTIES

Products purchased by Consumers on www.fralab.it are guaranteed for defects for 24 months. The Customer must report defects within two months of discovery.

11. INTELLECTUAL PROPERTY RIGHTS

All content on www.fralab.it is protected by intellectual property laws. Any reproduction, alteration, or distribution is prohibited.

12. APPLICABLE LAW AND JURISDICTION

Sales contracts are governed by Italian law. Disputes involving consumers fall under the jurisdiction of the Customer's residence. Otherwise, the court of Vicenza is competent.
